Not all information is subject to release. Some documents may be releasable but may require redaction of certain information. Examples of items that must be redacted include social security numbers, dates of birth, certain email addresses, account numbers, and information relating to an individual’s mental health and criminal history.
The most common examples of information that must be withheld in its entirety include complaint information and investigative files, disciplinary hearing materials, and licensure application files. These materials are specifically exempt from disclosure under the Texas Public Information Act (PIA). Consequently, when making a request to ECPTOTE under the PIA, please note that these documents/materials are exempt from release to the public.
The ECPTOTE response will request clarification for potentially confidential items and ask requestors whether they wish to modify or cancel the request.
